PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-17 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />STEVEN AND LAURA SPENCER FOR A MAJOR MODIFICATION, <br />AS FILED UNDER CASE PUD -99-01-05M <br />WHEREAS, Steven and Laura Spencer have applied for a major modification to an <br />approved PUD development plan, Case PUD -99-01, to reduce the rear <br />yard setback from the required 20 feet to five feet and the side yard <br />setback from the required ten feet to five feet for a pool in the rear yard of <br />the existing residence located at 8031 Oak Creek Drive; and <br />WHEREAS, zoning for the property is, PUD-R/LDR (Planned Unit Development — <br />Rural/Low Density Residential) District; and <br />WHEREAS, at its duly noticed public hearing of April 9, 2008, the Planning, <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, existing facilities consisting of the operation, permitting, licensing, or minor <br />alteration of structures involving no expansion of use beyond that existing <br />are categorically exempt from the. requirements of the California <br />Environmental Quality Act (CEQA) Section 15301, Class 1 (L)(4); and <br />WHEREAS, the Planning Commission determined that the proposed modification <br />would be consistent with other recently approved projects in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PUD -99-01-05M, the application of <br />Steven and ,Laura Spencer for a major modification to an approved PUD, <br />Case PUD -99-01, to reduce the rear yard setback from the required <br />20 feet to five feet and the side yard setback from the required ten feet to <br />five feet for a pool in the rear yard of the existing residence located at <br />8031 Oak Creek Drive, subject to the conditions shown in Exhibit B, <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective immediately upon its passage and <br />adoption. <br />
