PC -2008-15 <br />RESOLUTION DENYING THE APPEAL OF PAUL ESSER, THEREBY UPHOLDING <br />THE ZONING ADMINISTRATOR'S APPROVAL OF A VARIANCE FROM THE <br />PLEASANTON MUNICIPAL CODE, AS FILED UNDER CASE PAP -116 (PV -167) <br />WHEREAS, Rich and Lori Lortz have applied for a Variance from the Pleasanton <br />Municipal Code to: (1) reduce the street side yard setback of a corner lot <br />located at 2402 Crestline Road from the required ten feet to eight inches <br />(measured from eave to soundwall) for an existing accessory structure <br />and to five feet for an existing pool; (2) reduce the side yard setback from <br />the required three feet to one foot, eight inches and the rear yard setback <br />from the -required five feet to eight inches (measured from the eave to the <br />property line) for a second accessory structure; and (3) retain the existing <br />eight -foot tall hedges in the front yard where a maximum height of six feet <br />is allowed; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single -Family Residential) District; <br />and <br />WHEREAS, on January 10, 2008, the Zoning Administrator approved two of the three <br />variance requests as follows: (1) to reduce the street side yard setback <br />form the required ten feet to eight inches for an existing accessory <br />structure and to five feet for an existing pool; and (2) to retain the existing <br />eight -foot tall hedges in the front yard where a maximum height of six feet <br />is allowed. The third variance request to reduce the side yard setback <br />from the required three feet to one foot, eight inches, and the rear yard <br />setback from the required five feet to eight inches for a second accessory <br />structure was not granted, and the applicants were required to relocate the <br />shed to meet the required five-foot rear yard and three-foot side yard <br />setbacks; lower the shed to ground level and remove the steps to the <br />structure; work with staff regarding the placement and height of the <br />relocated structure prior to moving it; have a registered professional install <br />intumescent paint for one-hour firewall purposes; and obtain any <br />applicable City permits for the side and rear yard accessory structures; <br />and <br />WHEREAS, on January 25, 2008, Paul Esser filed an appeal of the Zoning <br />Administrator's decision to the Planning Commission; and <br />
