PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-13 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />AMAN AND TEE BAWA FOR A MAJOR MODIFICATION, <br />AS FILED UNDER CASE PUD -99-09-02M <br />WHEREAS, Aman and Tee Bawa have applied for a minor modification to an approved <br />PUD development plan, Case PUD -99-02, to allow additional grading and <br />retaining walls along the rear and side yard slope banks of the property <br />located at 2632 Ingrid Court and to relocate two developer -installed trees <br />along the rear yard slope bank of the property; and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development —Low <br />Density Residential) District; and <br />WHEREAS, the Zoning Administrator approved the application for a minor modification <br />on January 22, 2008; and <br />WHEREAS, on February 26, 2008, Xin Chen and Frank Nguyen filed an appeal of the <br />Zoning Administrator's decision to the Planning Commission, thus <br />changing the minor modification to a major modification of the PUD; and <br />WHEREAS, at its duly noticed public hearing of March 12, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission determined that the proposed modification <br />would be consistent with other recently approved projects in the area and <br />would not alter the natural topographical features of the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PUD -99-09-02M, the application of Aman <br />and Tee Bawa have applied for a minor modification to an approved PUD <br />development plan, Case PUD -99-02, to allow additional grading and <br />retaining walls along the rear and side yard slope banks of the property <br />located at 2632 Ingrid Court and to relocate two developer -installed trees <br />along the rear yard slope bank of the property, subject to the conditions <br />shown in Exhibit B, attached hereto and made part of this case by <br />reference. <br />
