PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-12 <br />RESOLUTION DENYING PAP -117, THE APPEAL OF XIN CHEN AND FRANK <br />NGUYEN, THEREBY UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL <br />OF AN ADMINISTRATIVE DESIGN REVIEW, AS FILED UNDER CASE PADR-1762 <br />WHEREAS, Aman and Tee Bawa have applied for an administrative design review <br />approval to construct an approximately 700 -square -foot, detached second <br />unit with an approximately 250 -square -foot covered porch at the property <br />located at 2632 Ingrid Court; and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development — Low <br />Density Residential) District; and <br />WHEREAS, the Zoning Administrator approved the application for administrative <br />design review on January 22, 2008; and <br />WHEREAS, on February 26, 2008, Xin Chen and Frank Nguyen filed an appeal of the <br />Zoning Administrator's decision to the Planning Commission; and <br />WHEREAS, at its duly noticed public hearing of March 12, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA), Class 3, <br />Section 15303(a), "New Construction or Conversion of Small Structures"; <br />and <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Denies Case PAP -117, the appeal of Xin Chen and Frank Nguyen, <br />thereby upholding the Zoning Administrator's approval of <br />Case PADR-1762, the application of Aman and Tee Bawa for an <br />administrative design review approval to construct an approximately <br />700 -square -foot, detached second unit with an approximately <br />250 -square -foot covered porch at the property located at 2632 Ingrid <br />Court, subject to -the conditions shown in Exhibit B, attached hereto and <br />made part of this case by reference. <br />
