PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-11 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />MICHAEL AMINIAN/MEDEIROS GARDENS, LLC FOR PLANNED UNIT <br />DEVELOPMENT (PUD) REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD -71 <br />WHEREAS, Michael Am,inian/Medeiros Gardens, LLC has applied for Planned Unit <br />Development (PUD) rezoning and development plan approval to rezone <br />an existing 0.876 -acre parcel located at 3835 Vineyard Avenue from the <br />RM -4,000 (Multiple -Family Residential) District to the PUD -HDR (Planned <br />Unit Development — High Density Residential) District and to construct ten <br />townhouse units; and <br />WHEREAS, at its duly noticed public hearing of February 27, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, in -infill development projects on sites of five acres or less that have no <br />habitat for endangered, rare, or threatened species that can be adequately <br />served by all required utilities and public services, that are consistent with <br />the General Plan and zoning regulations, and would have no significant <br />effects on traffic, noise, air quality, or water quality are categorically <br />exempt from the requirements of the California Environmental Quality Act <br />(CEQA) Guidelines, Section 15332(32)(a -e); and <br />WHEREAS, the Planning Commission determined that the proposed development plan <br />is appropriate for the site; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The plan is in the best interests of the public health, safety, and <br />general welfare. <br />As conditioned, the proposed development would meet City standards for <br />street improvements and utility design. Adequate storm drain, sanitary <br />sewer, and water service utilities are present in the area surrounding the <br />development and are sufficient to serve the proposed development. All <br />on-site infrastructure shall be installed by the project developer with <br />connections to municipal systems in order to serve the site. On-site guest <br />parking exceeding what is required by the parking ordinance has been <br />provided, and drive aisles and driveways will be designed and constructed <br />
