PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-01 <br />RESOLUTION APPROVING THE APPLICATION OF MICHAEL O'CALLAGHAN FOR <br />MODIFICATION OF A PREVIOUSLY APPROVED DESIGN REVIEW APPROVAL, <br />AS FILED UNDER CASE PDR -602 <br />WHEREAS, Michael O'Callaghan has applied for design review approval to modify a <br />previously approved design review for a two-story commercial building <br />with an attached apartment unit at 725 Main Street to reconsider Condition <br />No. 15.c. regarding the installation of pavers in front of the building and <br />Condition No. 72 regarding the installation of an automatic fire sprinkler <br />system for the building; and <br />WHEREAS, zoning for the property is C -C (Central Commercial) Downtown <br />Revitalization, Core Area Overlay District; and <br />WHEREAS, at its duly noticed public hearing of January 9, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission determined that Condition No. 15.c. was <br />contrary to the Main Street sidewalk design approved by the City Council <br />in 1993 as part of the Main Street Reconstruction Project; and <br />WHEREAS, the Planning Commission further determined that Condition No. 72 is in <br />keeping with Chapter 18.20 of the Municipal Code to ensure the <br />preservation of public health, safety, and general welfare. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves the deletion of Condition No. 15.c. of PDR -602 regarding the <br />installation of pavers in front of the building located at 725 Main Street and <br />the retention of Condition No. 72 regarding the installation of an automatic <br />fire sprinkler system for the building, subject to the conditions shown in <br />Exhibit B, attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
