THE CITY OF <br /> -1.11 CITY COUNCIL AGENDA REPORT <br /> LXirtöNm <br /> December 19, 2017 <br /> Community Development <br /> Planning Division <br /> TITLE: CONSIDER REQUEST FOR A PREANNEXATION AGREEMENT AND <br /> WATER AND SANITARY SEWER CONNECTIONS TO AN EXISTING <br /> PROPERTY LOCATED AT 622 HAPPY VALLEY ROAD (KULDEEP <br /> SINGH/BAP PROPERTIES LLC) <br /> SUMMARY <br /> Peter MacDonald, on behalf of the property owner of 622 Happy Valley Road, is <br /> requesting water and sanitary sewer service to be established to serve a future <br /> residence located within the Happy Valley Specific Plan (HVSP) area outside City limits. <br /> Prior to allowing a property located within the County to connect to the City water and <br /> sanitary sewer systems, the City requires the property owner to enter into a <br /> preannexation agreement. If the preannexation agreement is approved, the City must <br /> apply for and receive on the owner's behalf an out-of-area service agreement from the <br /> Alameda County Local Agency Formation Commission (LAFCo). The Livermore- <br /> Amador Valley Water Management Agency (LAVWMA) may also require approval of <br /> the water connection. <br /> RECOMMENDATION <br /> 1. Approve the Preannexation Agreement between BAP Properties LLC and the City of <br /> Pleasanton, subject to modifications approved by the City Manager and City Attorney, <br /> and authorize the City Manager to execute the agreement. <br /> 2. Authorize staff to file an application with LAFCo for the extension of water and <br /> sanitary sewer services to this property and authorize staff to seek LAVWMA <br /> approval, if needed, of the water connection. <br /> 3. Authorize connection of 622 Happy Valley Road (APN 949-0008-003-06) to the City <br /> water and sanitary sewer systems, provided: all connection work is done to the <br /> satisfaction of the City Engineer; all costs are borne by the property owner; and the <br /> proposed extension of City services is approved by LAFCo, and LAVWMA, if needed. <br /> FINANCIAL STATEMENT <br /> The property owner would be required to pay all costs associated with extending the <br /> sewer and water systems, including City, County, and LAFCo, and other agency fees <br /> and permitting costs. <br />
