<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-20 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF DONG YU REAL ESTATE DEVELOPMENT, AS FILED <br />UNDER CASE PUD-98-01 <br /> <br />WHEREAS, Dong Yu Real Estate Development has applied for PUD (Planned Unit <br />Development) development approval for a six-lot custom home development, which <br />revises the lot layout and roadway configuration for this 7.68 acre portion of the <br />property which was formerly part of a 22-lot subdivision on approximately 50.36:1: <br />acres located on the west side of Foothill Road at Equus Court; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR/RDR/OS (Planned Unit Development - Low <br />Density ResidentiaIlRural Density ResidentiaIlOpen Space) District; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared and certified for the previously- <br />approved Planned Unit Development rezoning and development plan approval, and <br />based on the requirements of the California Environmental Quality Act (CEQA) the <br />proposed modification to the development plan is within the scope of the EIR and <br />that a negative declaration must be adopted evaluating the proposed changes; and <br /> <br />WHEREAS, the Planning Commission has received and reviewed the Initial Study January 15, <br />1998, and received the recommendations of staff; and <br /> <br />WHEREAS, at its meeting of March 25, 1998, the Planning Commission received a proposed <br />negative declaration prepared for Case PUD-98-0l; and <br /> <br />WHEREAS, a duIy noticed public hearing was held at which time the public was given the <br />opportunity to comment on the environmental impacts of the proposal; and <br /> <br />WHEREAS, the Planning Commission has reviewed the potential impacts in accordance with the <br />applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS, the Planning Commission fmds that approval of the proposed project wouId not <br />have any significant adverse effects on the environment. <br />
