CITY OF PLEASANTON CITY COUNCIL SPECIAL AND REGULAR MEETING MINUTES July 18, 2017 Mayor Thorne called the special meeting to order at the hour of 6:00 p.m. Present: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne Absent: None The meeting adjourned to Closed Session for the following purpose: CONFERENCE WITH LABOR NEGOTIATORS pursuant to Government Code §54957.6: Agency representatives: Nelson Fialho and Debra Gill Employee organization: Pleasanton Police Officers Association CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION pursuant to Government Code §54956.9(a): City of Pleasanton v. Thomas Spitzer, Craig Spitzer—Alameda County Superior Court, Case No. RG126422060 The special meeting adjourned at 6:58 p.m. Mayor Thorne called the regular meeting to order at the hour of 7:00 p.m. Councilmember Brown led the pledge of allegiance and provided opening remarks ROLL CALL Present: Councilmembers Brown, Narum, Olson, Pentin, Mayor Thorne Absent: None AGENDA AMENDMENTS — None CLOSED SESSION REPORT City Attorney Sodergren stated that no action was taken in Closed Session. CONSENT CALENDAR Mayor Thorne opened the public hearings. Leroy Spitzer complained about a lawsuit, distribution of his property, his boat and the donation of his clothes to charity. He added he has lost approximately $200,000 in equipment. Tom Jensen, on behalf of Counsel for the Spitzer's, referenced a letter dated July 6th from Donald Schwartz, stating the City has no jurisdiction over the property, but rather is within the jurisdiction of the court. He referenced other documents, including an email sent today stating that attorney fees being assessed are unreasonable as well as an email from Special Counsel. He said the City is not following its own procedures and asked City Council not to decide on the matter, but read the documentation provided. Mayor Thorne closed the public hearings.
