THE CITY OF <br />AV l CITY COUNCIL AGENDA REPORT <br />pLEASANTON. <br />6 <br />TITLE: <br />APPLICANT: <br />APPELLANT: <br />September 20, 2016 <br />Community Development Department <br />Planning Division <br />UP- 77 -13, CONSIDER AN APPEAL OF THE PLANNING COMMISSION'S <br />APPROVAL TO MODIFY THE CONDITIONAL USE PERMIT FOR THE <br />OPERATION OF THE PLEASANTON MASONIC CENTER <br />City of Pleasanton <br />Jeff Renholts, Pleasanton Masonic Center <br />SUMMARY <br />In response to complaints received from adjacent neighbors and other residents in the Valley <br />Trails neighborhood, on June 22, 2016 the Planning Commission was presented with options <br />to retain without modifications, modify or revoke an existing Conditional Use Permit (CUP), <br />UP- 77 -13, for the operation of the Pleasanton Masonic Center (also referred as the <br />Pleasanton Masonic Lodge or the Masonic Center). The Planning Commission unanimously <br />chose to modify UP -77 -13 by adding new conditions of approval to address the adjacent <br />neighbors' concerns, substantially limiting use of the outdoor and patio area adjacent to the <br />Masonic Center, and imposing other new restrictions on existing operations. <br />Jeff Renholts, on behalf of the Pleasanton Masonic Center, appealed the Planning <br />Commission's decision, indicating that the imposed conditions would cause financial harm to <br />the Masonic Center and force its relocation. The letter of appeal is included in Attachment 2. <br />PLANNING COMMISSION ACTION <br />On June 22, 2016, the Planning Commission unanimously approved modifications to the <br />Pleasanton Masonic Center CUP (UP- 77 -13). <br />RECOMMENDATION <br />Staff recommends that the City Council choose either Option A, Option B, or some <br />combination of the two options (Attachment 1), as described below: <br />Option A: Deny the appeal, and approve modifications to UP -77 -13 for the Pleasanton <br />Masonic Center, with conditions approved by the Planning Commission. These conditions <br />define allowed primary and ancillary uses at the Masonic Center, establish specific hours of <br />operation for indoor and outdoor areas, and impose other restrictions, including limiting use of <br />outdoor areas adjacent to the Masonic Center to four times per year. <br />Option B: Deny the appeal, and approve modifications to UP -77 -13 for the Pleasanton <br />Masonic Center with conditions recommended by staff prior to the June 22, 2016 Planning <br />Commission hearing (Attachment 4). These conditions are similar to those in Option 1, but <br />with a more lenient (but still restrictive) policy for outdoor events. <br />
