THE CITY OF <br />pLEASANTONC <br />CITY COUNCIL AGENDA REPORT <br />July 19, 2016 <br />Community Development Department <br />Planning Division <br />TITLE: APPROVAL OF THE SECOND AMENDMENT TO THE PROFESSIONAL <br />SERVICES AGREEMENT WITH ENVIRONMENTAL SCIENCE ASSOCIATES <br />(ESA) FOR SERVICES IN THE AMOUNT NOT TO EXCEED $332,245, <br />FUNDED ENTIRELY BY NEARON ENTERPRISES, FOR ADDITIONAL <br />CONSULTANT ANALYSIS OF THE JOHNSON DRIVE ECONOMIC <br />DEVELOPMENT ZONE UNDERTAKEN FROM JULY 28, 2015 TO MAY 17, <br />2016 <br />SUMMARY <br />At its July 15, 2014 meeting, the City Council approved the award of a Professional <br />Services Agreement (Agreement) with ESA for preparation of a Supplemental <br />Environmental Impact Report (EIR) pursuant to the California Environmental Quality Act <br />(CEQA) and authorized the City Manager to enter into the above -noted Agreement with <br />ESA, as well as a reimbursement agreement with Nearon Enterprises for the full costs of <br />the Agreement (Attachment 3). The purpose of the Agreement, in the amount of <br />$142,326, was to evaluate the effects of the Johnson Drive Economic Development <br />Zone. <br />At its March 17, 2015 meeting, the City Council approved the First Amendment to the <br />Agreement (First Amendment) for additional consultant and subconsultant costs <br />associated with additional project area traffic analysis necessary for the Supplemental <br />EIR in an amount not to exceed $66,531, raising the total Agreement amount to <br />$208,857. <br />Staff is requesting approval of a Second Amendment to the Agreement to include ESA <br />and subconsultant costs associated with additional project analysis that has already been <br />completed and was necessary for the environmental and economic review <br />documentation in an amount not to exceed $332,245 (Attachment 2), raising the total <br />Agreement amount to $541,102. <br />RECOMMENDATION <br />1. Approve the Second Amendment to the Professional Services Agreement with ESA <br />for consultant costs associated with additional project analysis necessary for the <br />Johnson Drive Economic Development Zone environmental and economic review in <br />the amount not to exceed $332,245. <br />2. Authorize the City Manager to enter into the above -noted Second Amendment to the <br />Agreement with ESA (Attachment 1). <br />6 <br />
