THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> PL£ASANTONa <br /> June 7, 2016 <br /> City Manager's Office <br /> TITLE: APPROVE NOTICE OF OPPOSITION TO GOVERNOR'S BY RIGHT <br /> HOUSING PROPOSAL <br /> SUMMARY <br /> The Governor recently released the budget May Revise which included a "By Right" <br /> Housing Proposal that seeks to reduce the perceived additional costs and delays <br /> associated with the approval of housing developments containing specified percentages <br /> of affordable housing by eliminating public input and project-level environmental <br /> analysis, restricting design review, and making approval non-discretionary or <br /> "ministerial". <br /> The Governor's By Right Housing Proposal pre-empts local discretionary land use <br /> approvals, eliminates opportunities for public review of projects and project-level <br /> environmental review and restricts design review. These factors support the City taking <br /> an `oppose' position to the Governor's Proposal. <br /> RECOMMENDATION <br /> It is recommended that the City Council approve the Notice of Opposition to the <br /> Governor's By Right Housing Proposal. <br /> BACKGROUND <br /> As a component of the Governor's recently released budget May Revise, he proposed <br /> to reduce the perceived additional costs and delays as associated with the approval of <br /> housing developments containing specified percentages of affordable housing by <br /> eliminating public input and project level environmental analysis, restricting design <br /> review, and making approval non-discretionary or "ministerial". <br /> The proposal would allow developers to receive their projects approved by city staff in <br /> an expedited time frame based on whatever the general plan and "objective" zoning <br /> criteria are in effect, and authorizes staff to approve zoning changes, zoning variances <br /> and conditional use permits without public review. <br />
