RESOLUTION NO. 16-836 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS <br /> REGARDING A REFERENDUM MEASURE AND DIRECTING THE CITY ATTORNEY <br /> TO PREPARE AN IMPARTIAL ANALYSIS <br /> WHEREAS, a Special Municipal Election is to be held in the City of Pleasanton, California, on <br /> June 7, 2016, at which there will be submitted to the voters the following referendum measure: <br /> "Shall the Lund Ranch project in Southeast Pleasanton, which consists <br /> of 43 single-family homes on approximately 17 acres and 174 acres for <br /> permanent public open space and 2 miles of public trails, be approved?" <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, <br /> DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br /> Section 1. Establishes March 17, 2016 and March 24, 2016, respectively, as the deadlines <br /> for submission of direct arguments and rebuttal arguments for the measure. Direct arguments not <br /> exceeding 300 words and rebuttal arguments not exceeding 250 words regarding the measure as <br /> specified above, shall be accompanied by the printed name(s) and signature(s) of the author(s) <br /> submitting it, in accordance with Elections Code § 9283. The arguments may be changed or withdrawn <br /> until and including the date fixed by the City Clerk after which no arguments for or against the referendum <br /> measure may be submitted to the City Clerk. The arguments shall be accompanied by the Form of <br /> Statement To Be Filed By Author(s) of Argument. <br /> Section 2. Authorizes Mayor Thome and Councilmember Narum to assist with writing a direct <br /> argument in favor of measure, and authorizes Councilmembers Olson and Pentin to assist in writing a <br /> rebuttal to the direct argument against the measure, and gives preference and priority to such arguments <br /> pursuant to Elections Code §9287(b), and delegates to Vantana Hills Steering Committee the selection <br /> of other persons to sign such arguments. <br /> Section 3. Authorizes Councilmember Brown to assist with writing a direct argument in <br /> against the measure, and a rebuttal to the direct argument in favor of the measure, and gives preference <br /> and priority to such arguments pursuant to Elections Code §9287(b); and delegates to referendum <br /> proponents the selection of other persons to sign such arguments. <br /> Section 4. The city attorney shall prepare an impartial analysis of the referendum measure <br /> not exceeding 500 words showing the effect of the referendum measure on the existing law and the <br /> operation of the referendum measure. <br /> (a) The analysis shall include a statement indicating whether the referendum measure was <br /> placed on the ballot by a petition signed by the requisite number of voters or by the governing body of <br /> the city. <br /> (b) The impartial analysis shall be filed by the date set by the City Clerk for the filing of direct <br /> arguments. <br /> Section 5. That the City Clerk shall certify to the passage and adoption of this resolution and <br /> enter it into the book of original resolutions. <br />
