RESOLUTION NO. 16-828 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ESTABLISHING AN INTERIM CITY POLICY TO NOT ACCEPT APPLICATIONS FOR <br /> PRE-ANNEXATION OR ANNEXATION IN HAPPY VALLEY; WITH EXCEPTIONS FOR <br /> A HEALTH AND SAFETY EMERGENCY <br /> WHEREAS, the City Council adopted policies on December 3, 2002 regarding when to <br /> consider approval of water and sewer connections within the unincorporated Happy Valley, and <br /> directed staff to accept applications to connect any existing house or new house on an existing, <br /> vacant lot; and <br /> WHEREAS, at the meeting of September 11, 2014, the Alameda County Local Agency <br /> Formation Commission (LAFCo) directed the City to complete a study, in consultation with the <br /> County, to identify how water and sewer services could be provided to the unincorporated <br /> Happy Valley area properties; and <br /> WHEREAS, at the meeting of February 16, 2016, the City Council received a report from <br /> the Director of Engineering and Director of Community Development regarding recent requests <br /> from Happy Valley property owners to annex or connect to City water and/or sewer services; <br /> and <br /> WHEREAS, the Department of Engineering will be undertaking a water and sewer study <br /> to evaluate the existing and needed infrastructure in Happy Valley in response to these utility <br /> connection requests and LAFCo's request; and <br /> WHEREAS, the objective of the Happy Valley water and sewer study is to <br /> comprehensively evaluate existing and needed utility and public infrastructure to serve all <br /> properties in Happy Valley; and <br /> WHEREAS, this interim policy is exempt from any further requirements of the California <br /> Environmental Quality Act as provided by Title 14 California Code of Regulations §15262 as it <br /> relates to a feasibility and planning study for Happy Valley utilities. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1: The City Council directs staff to not accept applications for pre-annexation <br /> agreements and annexation requests for properties within Happy Valley until the water and <br /> sewer study is completed and reviewed by the City Council. The City Council may revise this <br /> interim policy in the future to accept applications. Exceptions to this interim policy include cases <br /> of an emergency as determined by the Director of Engineering and LAFCo's policies and <br /> California law regarding an "existing or pending public health and safety threat" pursuant to <br /> Government Code §56133(c). <br /> SECTION 2: Formal applications for annexation or pre-annexation already accepted by <br /> the City would be processed. <br /> SECTION 3: This resolution shall become effective immediately upon its passage and <br /> adoption. <br />
