RESOLUTION NO. 16-827 • <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ACCEPTING RIGHT OF WAY DEDICATION ON HOPYARD ROAD AND <br /> AUTHORIZING THE QUITCLAIM OF A PORTION OF THE NORTHEAST CORNER <br /> OF JOHNSON COURT <br /> WHEREAS, the current owner, Delta Properties, of 6111 Johnson Court, has offered to <br /> dedicate an area of land to the City that runs along their easterly property line and is adjacent to <br /> Hopyard Road for street right of way purposes per PUD-100 Condition of Approval No. 33 and <br /> in exchange for City property to be quitclaimed; and <br /> WHEREAS, in 1970 the California Highway Commission (now known as the California <br /> Transportation Commission) relinquished Johnson Court property to the City as shown on the <br /> map entitled "PROPOSED RELINQUISHMENT IN THE COUNTY OF ALAMEDA" filed on April <br /> 30, 1970 (Serial 70-44456) at the County of Alameda Clerk-Recorder's Office; and <br /> WHEREAS, the property on the northeast corner of Johnson Court is not planned to be <br /> used for street right of way purposes; and <br /> WHEREAS, Delta Properties, the current owner of 6111 Johnson Court, has requested <br /> that the City formally abandon this excess property adjacent to their property because it is no <br /> longer needed for street right of way purposes and deed it to them; and <br /> WHEREAS, the City Council finds that acceptance of said area of land provides for the <br /> right of way needed to construct a right turn lane from southbound Hopyard Road to westbound <br /> Owens Drive. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City will accept the street right of way dedication offered by the <br /> property owner of 6111 Johnson Court. <br /> SECTION 2. The City Council finds that the property on the northeast corner of <br /> Johnson Court relinquished by the California Highway Commission (now known as the <br /> California Transportation Commission) to the City in 1970, as shown on Exhibit A, is excess <br /> property and not needed for street purposes. <br /> SECTION 3. The City will quitclaim the excess property to the current owner of 6111 <br /> Johnson Court. <br /> SECTION 4. The City Manager is authorized to execute the quitclaim deed and street <br /> right of way dedication deed and the City Clerk is directed to cause such documents to be <br /> recorded in the Alameda County Records. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on February 16, 2016. <br />
