RESOLUTION NO. 16-819 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, ADOPTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS AND THE MITIGATION MONITORING AND REPORTING PROGRAM FOR THE LUND RANCH II DEVELOPMENT, AS FILED UNDER CASE PUD-25 WHEREAS, the City of Pleasanton, acting as lead agency under the California Environmental Quality Act (CEQA), prepared a Draft Environmental Impact Report for the Lund Ranch II project which was published in July 2014 and provided proper legal notice of document preparation and availability; and WHEREAS, the Planning Commission held a noticed public hearing on August 27, 2014 to accept oral and written comments on the Draft Environmental Impact Report during the forty-five- day public review period, and the City also accepted and responded to written comments to the Draft Environmental Impact Report received from public agencies having jurisdiction by law, persons having special expertise with respect to any environmental impact involved, and other persons or organizations having an interest in the proposed project; and WHEREAS, the Final Environmental Impact Report has been prepared and contains the Draft Environmental Impact Report, comments and recommendations received on the Draft Environmental Impact Report, and the responses of the City of Pleasanton to comments raised regarding environmental issues in the review and consultation process; and WHEREAS, the City provided proper notice of completion of the Final Environmental Impact Report; and WHEREAS, on December 1, 2015, the City Council certified the Final Environmental Impact Report for the project as adequate and complete and adopted CEQA Findings and Mitigation Monitoring and Reporting Program for the project. WHEREAS, on December 15, 2015, the City Council proposed modifying the Project to reduce the number of units from 48 to 43 units and lowered the maximum elevation of the building pad for Lot 32. The City Council also proposed that 12 lots would connect to Lund Ranch Road and 31 lots would connect to Sunset Creek Lane. WHEREAS, these proposed project modifications will not result in any new or substantially increased impacts and there is no significant new information available since December 1, 2015 that would require preparation of a Subsequent EIR under CEQA Section 21166. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City Council re-adopts the CEQA Findings and Mitigation Monitoring and Reporting Program for the project as modified and attached hereto as Exhibit A. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. 1
