October 6, 2015 Community Development Planning Division TITLE: CONSIDER REQUEST FOR A PREANNEXATION AGREEMENT AND WATER AND SEWER CONNECTIONS FOR APN 949-0007-016-02 (NAVA!) SUMMARY The property owners of a vacant property on Sycamore Road (no address has been assigned yet) are requesting that water and sewer service be established to serve their proposed residence located within the Happy Valley Specific Plan area, outside City limits. Alameda County's Department of Environmental Health restricts the installation of new septic systems when a sanitary sewer main is within 200 feet of a property. Therefore, the property owners are requesting connection to the City sewer and water systems for a new home to be constructed on the subject property. Prior to allowing a property located within the County to connect to City water and sewer systems, the City requires the property owner to enter into a preannexation agreement. If the preannexation agreement is approved, the City must apply for and receive on the owner's behalf an "out-of-area service" agreement from the Alameda County Local Agency Formation Commission (LAFCo). The Livermore-Amador Valley Water Management Agency (LAVWMA) may also require approval of the connection. RECOMMENDATION 1. Approve the preannexation agreement between the Navais and the City of Pleasanton, subject to modifications approved by the City Manager and City Attorney, and authorize the City Manager to execute the agreement. 2. Authorize staff to file an application with LAFCo for the extension of water and sewer service to this parcel, and authorize staff to seek LAVWMA approval, if needed, of the connection. 3. Authorize one connection of the Navai parcel located at APN 949-0007-016-02 to the City water and sanitary sewer system, provided: all connection work is done to the satisfaction of the City Engineer; all costs are borne by the property owners; and the proposed extension of City services is approved by LAFCo and LAVWMA, if needed.
