11 <br />ORDINANCE NO. 2122 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF SHAC LAS POSITAS APARTMENTS <br />LLC FOR A PUD MAJOR MODIFICATION AS FILED UNDER CASE NO. P15- <br />0170 <br />WHEREAS, SHAC Las Positas Apartments LLC has applied for Planned Unit <br />Development (PUD) Major Modification to City Council Ordinance No. 2030 to modify <br />the minimum density requirement of 30 dwelling units /acre to a density of 15.9 dwelling <br />units /acre for the construction of 94 condominium units and related site improvements <br />at 5.9 -acre site located at 5850 West Las Positas Boulevard (the "Project "); and <br />WHEREAS, zoning for the property is Planned Unit Development — Mixed Use <br />(PUD -MU) District; and <br />WHEREAS, the Planning Commission at its regular meeting on May 13, 2015 <br />adopted Resolution PC- 2015 -09, determining that the proposed PUD major modification <br />is appropriate for the site, making findings, and recommending to the City Council that <br />Case No. P15 -0170 be approved; and <br />WHEREAS, on June 16, 2015, the City Council held a duly noticed public <br />hearing on this application and considered all public testimony, agenda reports, related <br />materials, and the recommendations of City staff and the Planning; and <br />Commission; and <br />WHEREAS, the City Council determined that the conditions described in <br />California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br />occurred and finds that the previously certified Supplemental Environmental Impact <br />Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br />Considerations in City Council Resolution 12 -492, and the Addendum to the SEIR for <br />the Project and SHAG (SummerHill Home) Las Positas Townhome Condominiums — <br />CEQA Addendum Substantial Conformity memo, are adequate to serve as the <br />environmental documentation for the Project and satisfy all the requirements of CEQA; <br />and <br />WHEREAS, the City Council finds that the proposed PUD development plan <br />major modification is consistent with the City's General Plan and purposes of the PUD <br />ordinance. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />
