THE CITY OF J <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONa <br /> June 2, 2015 <br /> Community Development <br /> Engineering Division <br /> TITLE: APPROVE THE FINAL MAP, IMPROVEMENT PLANS, AGREEMENT FOR <br /> FINAL MAP APPROVAL, AND DEFERRAL OF BONDS AND FEES FOR <br /> TRACT 7660 (CHRISMAN PROPERTY) <br /> SUMMARY <br /> Tract 7660 creates 10 new single-family detached residential lots and five parcels- Parcel <br /> A for the existing Chrisman residence, Parcels B and C for open space easements, Parcel <br /> D1 for a public equestrian & pedestrian trail and recreation purposes, and Parcel D2 for <br /> an open space easement and public service easement at 1944 Three Oaks Drive. The <br /> subject property is located south of Old Vineyard Avenue and adjacent to the Berlogar <br /> Property (Silver Oaks Estates) and will share the public street Silver Oaks Lane. Staff has <br /> reviewed the Final Map and improvement plans and has found them to be in substantial <br /> compliance with the approved Vesting Tentative Map. The developer has requested <br /> deferral of the subdivision bonds, inspection fees, and subdivision improvement <br /> agreement, which can be accommodated through escrow protections for the City. <br /> PLANNING COMMISSION RECOMMENDATION <br /> On July 9, 2003, the Planning Commission denied approval of the Vesting Tentative Map, <br /> which was appealed by the former developer Northstar Construction and Development <br /> (successor developer to Centex Homes). On August 19, 2003, the City Council approved <br /> Northstar's appeal of Tract 7399, effectively approving the Vesting Tentative Map. <br /> RECOMMENDATION <br /> 1. Approve Improvement Plans and the Final Map for Tract 7660 (Chrisman Property). <br /> 2. Authorize the City Manager to execute the Agreement for Final Map Approval Without <br /> Improvement Agreement or Bonds for this development, and approve deferral of <br /> payment of City development impact fees and Vineyard Avenue Corridor Specific Plan <br /> fees until final inspection of new homes, or connection of existing home to City water. <br /> 3. Authorize deferral of subdivision bonds, inspection fees, and subdivision improvement <br /> agreement subject to final map being held in escrow and only released when such <br /> bonds and fees are collected. <br /> 4. Accept all parcels of land and easements offered for dedication on the Final Map. <br /> 5. Authorize the City Manager to execute all related documents when approved as to <br /> form by the City Attorney. <br />
