THE CITY Of CITY COUNCIL AGENDA REPORT 3 PL EASANTONo March 17, 2015 Community Development Planning Division TITLE: APPROVAL OF THE FIRST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH ENVIRONMENTAL SCIENCE ASSOCIATES (ESA) FOR SERVICES IN THE AMOUNT NOT TO EXCEED $66,531 FOR ADDITIONAL CONSULTANT AND SUBCONSULTANT TRAFFIC ANALYSIS ASSOCIATED WITH THE JOHNSON DRIVE ECONOMIC DEVELOPMENT ZONE ENVIRONMENTAL IMPACT REPORT (EIR) SUMMARY At its July 15, 2014, meeting, the City Council approved the award of a Professional Services Agreement (Agreement) with ESA for preparation of an EIR pursuant to the California Environmental Quality Act (CEQA) evaluating the effects of the Johnson Drive Economic Development Zone in the amount of $142,326, and authorized the City Manager to enter into the above-noted Agreement with ESA, as well as a reimbursement agreement with Nearon Enterprises for the full costs of the Agreement (Attachment 3). Staff is requesting approval of a First Amendment to the Agreement to include ESA and subconsultant costs associated with additional project area traffic analysis necessary for the EIR in an amount not to exceed $66,531 (Attachment 2), raising the total Agreement amount to $208,857. RECOMMENDATION 1. Approve the First Amendment to the Professional Services Agreement with ESA for consultant and subconsultant costs associated with additional project area traffic analysis necessary for the Johnson Drive Economic Development Zone EIR in the amount not to exceed $66,531. 2. Authorize the City Manager to enter into the above-noted First Amendment to the Agreement with ESA (Attachment 1). FINANCIAL STATEMENT Like the initial costs of the Agreement, the First Amendment costs would be paid in full by Nearon Enterprises, pursuant to the approved reimbursement agreement. Planning Division review and administration of the project will continue to be conducted by staff and is part of the Current Planning budget.
