RESOLUTION NO. 14-670 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING THE MASTER FEE SCHEDULE TO SET A PENALTY FOR PARKING IN <br /> A DISABLED PARKING SPACE WITHOUT DISPLAYING APPROPRIATE PLACARD <br /> OR LICENSE PLATE <br /> WHEREAS, Pleasanton Municipal Code Chapter 11.36 Stopping, Standing and Parking <br /> includes the regulation of parking spaces marked as blue to indicate parking limited exclusively <br /> to vehicles of physically disabled persons; and <br /> WHEREAS, the Police Department often has persons appeal citations for parking in <br /> disabled persons parking spaces without the required placard or license plate, and such <br /> appellants claim that they did in fact have such a placard but simply did not display it so it could <br /> be seen; and <br /> WHEREAS, to prevent fraud and encourage persons to properly display their placard, <br /> the Police Department proposes a $25 penalty for failure to display one's disabled parking <br /> placard while parking in a marked disabled parking space, which amount is allowed by <br /> California Vehicle Code §40226 and which amount is less than the true cost of Police <br /> Department traffic sergeant review of such appeals and other administrative costs for <br /> processing parking ticket appeals. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. It amends the Master Fee Schedule, Section V. Police Department, <br /> Subsection H. Parking Penalties, to add a Twenty Five dollar ($25) penalty for"Parking in space <br /> designated for Disabled without displaying either special license plate or distinguishing placard" <br /> pursuant to California Vehicle Code §40266. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 15, 2014. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 15th day of April <br /> 2014, by the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> Karen Diaz, City C er <br /> APPROVED AS TO FORM: <br /> Jon tir t Lowell, City Attorney <br />
