RESOLUTION NO. 14-665 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A GROWTH MANAGEMENT AGREEMENT BETWEEN THE <br /> CITY OF PLEASANTON AND SHAC LAS POSITAS APARTMENTS, L.L.C. <br /> FOR THE PROJECT AT 5850 WEST LAS POSITAS BOULEVARD AS FILED <br /> UNDER CASE NO PUD-81-30-88D <br /> WHEREAS, the City has approved,PUD-81-30-88D for a multi-family residential/ <br /> development at 5850 West Las Positas Boulevard ("the Project") being developed by <br /> SHAC Law Positas Apartments, L.L.C.; and <br /> WHEREAS, Ordinance 2054 of the City of Pleasanton sets forth a Growth <br /> Management Program (at Chapter 17.36 of the Pleasanton Municipal Code) which <br /> authorizes the City to enter into agreements with developers to achieve orderly growth <br /> rates for residential development; and <br /> WHEREAS, Ordinance 2054 states that for the current Regional Housing Needs <br /> Allocations (RHNA) cycle (the fifth cycle, ending June 30, 2014), the annual Growth <br /> Management unit allocation shall be equal to the number of units required to meet the <br /> City's RHNA for the fifth cycle; and <br /> WHEREAS, the Project's units would be used to meet the RHNA for the fifth <br /> cycle; and <br /> WHEREAS, a duly noticed hearing concerning the Growth Management <br /> Agreement was held by the City Council,on March 18, 2014; and <br /> WHEREAS, the City Council finds that it is in the best interest of the City to enter <br /> into a Growth Management Agreement for the above referenced PUD. • <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Approves the Growth Management Agreement with SHAC Las <br /> Positas Apartments, L.L.C. for PUD-81-30-88D in substantially the same form as the <br /> agreement attached hereto as Exhibit A, which is incorporated herein by this reference, <br /> and a uthorizes the City Manager to sign the agreement when approved as to final form <br /> by the City Attorney. <br /> SECTION 2. This resolution shall become effective immediately upon the <br /> effective date of the ordinance approving the PUD development plan for this project. <br />
