THEF 4 <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON. <br /> November 5, 2013 <br /> Community Development <br /> Planning Division <br /> TITLE: P13-2191, HACIENDA OWNERS ASSOCIATION (JAMES PAXSON) — <br /> CONSIDER INTRODUCTION OF AN ORDINANCE MODIFYING THE <br /> DEVELOPMENT AGREEMENTS IN HACIENDA PHASE I AND PHASE II <br /> TO EXTEND THE DEVELOPMENT AGREEMENTS BY FIVE YEARS <br /> FROM 2013 TO 2018 ON THE PROPERTIES LOCATED AT 5901 AND <br /> 6001 GIBRALTAR DRIVE, 4225 AND 4300 HACIENDA DRIVE, 5800 AND <br /> 5805 OWENS DRIVE, 4501 ROSEWOOD DRIVE, AND 4747 WILLOW <br /> ROAD. <br /> SUMMARY <br /> This is the application by the Hacienda Owners Association (James Paxson) to extend <br /> the Development Agreements for several properties in Hacienda Phase I and Phase II for <br /> an additional five years from 2013 to 2018. Extending the Development Agreements <br /> would preserve the Hacienda PUD regulations and conditions that were in place for these <br /> properties enabling them to proceed with their development without concern that the <br /> Hacienda regulations and conditions could be modified. Developments on these <br /> properties would be subject to new General Plan policies and programs. <br /> PLANNING COMMISSION ACTION <br /> On October 9, 2013, the Planning Commission, on a 5-0 vote, found that the amendment <br /> to the Development Agreement (Attachment 1) is consistent with the Pleasanton General <br /> plan and recommended its approval. <br /> RECOMMENDATION <br /> Staff recommends the City Council: 1) find that the environmental impacts of the <br /> development agreement extensions have been adequately addressed in the General <br /> Plan Final EIR and the Supplemental EIR (and associated findings and Statement of <br /> Overriding Considerations) for the Housing Element Update and Climate Action Plan <br /> Amendments and Rezonings; 2) find that the amendment to the Development <br /> Agreements is consistent with the Pleasanton General Plan; and, 3) introduce the draft <br /> ordinance approving the extension of the Development Agreements (Attachment 1). <br /> FINANCIAL STATEMENT <br /> Since this is only an extension to the Development Agreements, there is no fiscal impact <br /> to the City. Building permit and development fees will be paid at the time of <br /> development. <br />
