THE CITY OF 6 (a) <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONe <br /> August 6, 2013 <br /> Community Development <br /> Flanning Division <br /> TITLE: CONSIDER (1) INTRODUCTION OF AN ORDINANCE APPROVING A <br /> PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN TO <br /> CONSTRUCT 345 APARTMENT UNITS, AN APPROXIMATELY 38,781 SQ. <br /> FT. RETAIL CENTER CONSISTING OF FOUR BUILDINGS, NEW SURFACE <br /> PARKING, AND RELATED SITE IMPROVEMENTS ON APPROXIMATELY 16 <br /> ACRES LOCATED AT 3150 BERNAL AVENUE (SOUTHEAST CORNER OF <br /> BERNAL AVENUE AND STANLEY BOULEVARD); (2) INTRODUCTION OF <br /> AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT; (3) AN <br /> AFFORDABLE HOUSING AGREEMENT; AND (4) A GROWTH <br /> MANAGEMENT AGREEMENT. <br /> SUMMARY <br /> The applications are for a high-density residential/commercial development containing <br /> 345 apartment units and up to approximately 38,781 square-feet of retail space at 3150 <br /> Bernal Avenue. Related land use entitlements include an affcrdable housing <br /> agreement, a growth management agreement, and a development agreement. <br /> HOUSING COMMISSION RECOMMENDATION <br /> On June 20, 2013, the Housing Commission recommended approval of an Affordable <br /> Housing Agreement as described in Attachment 2. <br /> PLANNING COMMISSION RECOMMENDATION <br /> On July 10, 2013, the Planning Commission recommended approval of the PUD <br /> development plan application subject to the conditions shown in Exhibit A (Attachment <br /> 1) and recommended approval of the development agreement. <br /> RECOMMENDATION <br /> 1. Find that the conditions described in CEQA Guidelines Section 15162 have not <br /> occurred as described in the Addendum to the SEIR and find that the previously <br /> prepared SEIR, including the adopted CEQA Findings and Statement of Overriding <br /> Considerations, and the Addendum to the SEIR are adequate 10 serve as the <br /> environmental documentation for this project and satisfy all the requirements of <br /> CEQA; <br /> 2. Find that the proposed PUD development plan and development agreement are <br /> consistent with the General Plan; <br /> 3. Make the PUD findings for the proposed development plan as stated in the July 10, <br /> 2013, Planning Commission staff report (pages 27-30 in Attachment 9); <br />
