9 THE CITY 01 men- pL£ASANTONe CITY COUNCIL AGENDA REPORT June 18, 2013 Community Development Planning Division TITLE: SECOND READING AND ADOPTION OF PLANNED UNIT DEVELOPMENT PLAN (PUD-81-30-87D) TO CONSTRUCT 168 APARTMENT UNITS AND RELATED SITE IMPROVEMENTS AT 5729 WEST LAS POSITAS BOULEVARD SUMMARY On May 21, 2013, the City Council introduced an ordinance approving a Planned Unit Development Plan (PUD-81-30-87D) for a 168 unit apartment project at 5729 West Las Positas Boulevard (Hacienda St. Anton Apartments). It is now appropriate to waive the second reading and adopt the ordinance. The ordinance reflects revisions to the conditions of approval made by the City Council on May 21, 2013. PLANNING COMMISSION RECOMMENDATION The Planning Commission recommended approval of the development plan application (4-0-1 with Narum abstaining) subject to the conditions shown in Exhibit A of the Planning Commission report with amendments made at the Planning Commission meeting. RECOMMENDATION Waive the second reading and adopt the ordinance approving Case PUD-81-30-87D, PUD development plan, subject to the Conditions of Approval, Exhibit A (Attachment 1). FINANCIAL STATEMENT The project would be expected to generate revenues to cover its costs of services. Increases in property and sales taxes would be used to provide services, such as police, fire, etc., for the increased demand generated by the apartments. The applicant would have to pay development impact fees (e.g., in-lieu park dedication fee, public facilities fee, traffic fees, water/sewer connections fees, etc.) that are used to pay for the cost of new City facilities and infrastructure necessitated by development.
