THE CITY OF 2 <br /> _ T <br /> pL£ASANTONo CITY COUNCIL AGENDA REPORT <br /> June 18, 2013 <br /> Law Department <br /> TITLE: AUTHORIZE CITY ATTORNEY TO ENTER INTO ON BEHALF OF <br /> CITY OF PLEASANTON WITH COUNTY OF ALAMEDA <br /> CERTIFICATION AND MUTUAL INDEMNIFICATION AGREEMENT <br /> RELATING TO COLLECTION OF TAXES, ASSESSMENTS AND <br /> FEES THROUGH SECURED PROPERTY TAX BILLS <br /> SUMMARY <br /> The County of Alameda collects through secured property tax bills certain taxes, <br /> assessments and fees imposed by the City of Pleasanton. The County requires the City <br /> to enter into an agreement whereby each entity agrees to indemnify the other in the <br /> event of claims or litigation arising from an alleged error in complying with the <br /> requirements of Proposition 218 (Articles XIIIC and XIIID of the California Constitution). <br /> RECOMMENDATION <br /> Authorize the City Attorney to enter into on behalf of the City of Pleasanton the Mutual <br /> Indemnification Agreement between the County of Alameda and the City. <br /> FINANCIAL STATEMENT <br /> There is no financial impact stemming from this agreement. Upon entering into it, the <br /> County will proceed with the normal collection of taxes through the Secured Property Tax <br /> rolls and distribution of tax proceeds to the City. <br />
