THE CITY OF Q <br /> CITY COUNCIL AGENDA REPORT 8 <br /> pLEASANTONo <br /> June 4, 2013 <br /> Community Development <br /> Planning Division <br /> TITLE: PUD-84-04-07M, CONSIDER AN APPLICATION FOR A PUD (PLANNED <br /> UNIT DEVELOPMENT) MAJOR MODIFICATION TO THE APPROVED <br /> PUD (PUD-84-04) GOVERNING THE MEADOW PLAZA SHOPPING <br /> CENTER TO ALLOW MASSAGE ESTABLISHMENTS WHERE THREE OR <br /> FEWER MASSAGE TECHNICIANS PROVIDE MASSAGE SERVICES AT <br /> ANY ONE TIME AS A PERMITTED USE AND MASSAGE <br /> ESTABLISHMENTS WHERE FOUR OR MORE MASSAGE TECHNICIANS <br /> PROVIDE MASSAGE SERVICES AT ANY ONE TIME AS A <br /> CONDITIONALLY PERMITTED USE. <br /> SUMMARY <br /> Meadow Plaza Shopping Center is a Planned Unit Development (PUD) that has an <br /> approved list of permitted and conditionally permitted uses. Massage establishments as a <br /> stand-alone business are not currently permitted. Therefore, the applicant, Tranquil <br /> Massage Center, applied for a minor modification to PUD-84-04 (Meadow Plaza Shopping <br /> Center) to allow massage establishments as permitted and conditionally permitted uses. <br /> During the staff level minor modification public notification process, staff received an email <br /> from John Ho stating his objection to allowing massage establishments within Meadow <br /> Plaza Shopping Center. Since staff received an objection to the minor modification <br /> request, it could no longer be processed at staff level and became a major modification to <br /> the PUD. PUD Major modifications require review and recommendation from the Planning <br /> Commission to the City Council for action. The Planning Commission recommended <br /> approval of the application at their May 8, 2013, meeting and, accordingly, the application <br /> is now before the Council for action. <br /> PLANNING COMMISSION ACTION <br /> At their May 8, 2013, meeting, the Planning Commission unanimously recommended <br /> approval of the application. <br /> RECOMMENDATION <br /> Staff recommends that the City Council introduce the draft ordinance approving PUD-84- <br /> 04-07M (Attachment 1). <br /> FINANCIAL STATEMENT <br /> Business license fees would apply to new massage establishmenis and Community <br /> Development fees would apply to building permits (i.e., interior tenant improvements); <br /> therefore, no fiscal impact on the City is anticipated. <br />
