THE CITY OF <br /> ., 11 CITY COUNCIL AGENDA REPORT 2 <br /> pLEASANTONO <br /> June 4, 2013 <br /> City Attorney <br /> TITLE: ADDITIONAL TWO MONTH EXTENSION OF AGREEMENT PROVIDING <br /> FOR RENT STABILIZATION OF MOBILEHOME SPACE RENTS FOR THE <br /> HACIENDA MOBILEHOME PARK <br /> SUMMARY <br /> The City has had mobilehome rent stabilization agreements for three of its four <br /> mobilehome parks since 1988. Such agreements exempt a park owner from regulation <br /> under the City's mobilehome space rents ordinance set forth in Chapter 6.60 of the <br /> Municipal Code. The existing 2007 agreement with the owner of the Hacienda <br /> Mobilehome Park was to expire December 31, 2012. The City Manager approved a two <br /> month extension of that agreement on December 26, 2012 and the City Council ratified <br /> that extension on January 15, 2013. The City Manager approved an additional one <br /> month extension of that agreement on February 27, 2013 and the City Council ratified <br /> that extension on March 5, 2013. A third extension was entered into on March 31, 2013 <br /> and ratified by the City Council on April16, 2013. A fourth extension was entered into on <br /> May 2, 2013 and ratified by the City Council on May 7, 2013. Staff continues to work <br /> with the owner of that park and its residents to negotiate a new agreement, but an <br /> agreement has not yet been reached. An additional two month extension of the <br /> agreement is reasonable as it can allow the parties to continue to move toward a <br /> resolution of the issues before them. The park owner has agreed to such an extension, <br /> and the Hacienda Mobilehome Park Resident's Agreement Committee has indicated its <br /> approval. On May 31 , 2013, the City Manager signed a Fifth Amendment to <br /> Agreement Providing for Stabilization of Mobilehome Space Rents between the City and <br /> the owner of the Hacienda Mobilehome Park. City Council action is now requested to <br /> ratify the City Manager's signature on that Fifth Amendment to Agreement Providing <br /> for Stabilization of Mobilehome Space Rents in Hacienda Mobilehome Park. <br /> RECOMMENDATION <br /> Ratify the City Manager's action of May 31, 2013 to sign the Fifth Amendment to <br /> Agreement Providing for Stabilization of Mobilehome Space Rents between the City and <br /> the owner of the Hacienda Mobilehome Park. <br /> FINANCIAL STATEMENT <br /> There is no financial impact to the City. Residents of Hacienda Mobilehome Park will <br /> pay the same rent as they did in January, February, March, April and May 2013. <br />
