ORDINANCE NO. 2066 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING TITLE 18 OF THE PLEASANTON MUNICIPAL CODE TO ADD CHAPTER 18.70, RIDGELINE AND HILLSIDE PROTECTION AND PRESERVATION, TO COMPLY WITH THE PROVISIONS OF MEASURE PP AND THE GOALS, POLICIES, AND PROGRAMS OF THE PLEASANTON GENERAL PLAN 2005 -• 2025 RELATED TO MAINTAINING THE CHARACTER OF THE HILLSIDE AREAS OF THE CITY, AS FILED UNDER CASE P12-1796 WHEREAS, in November 2008, voters adopted Measure PP, which amended the Pleasanton General Plan regarding hillside area development; WHEREAS, the goals, policies, and programs of the Land Use Element of the Pleasanton General Plan 2005 — 2025 incorporate Measure PP and generally call for the preservation of hillside and ridgeline areas of the City; WHEREAS, the predominant views of the hillside and ridgeline areas of the City are to be preserved to retain the sense of identity that these areas impart to the City and, therefore, are to be protected from inappropriate development; WHEREAS, development standards must also maintain the ability of the City to meet community goals for services including, but not limited to, public and regional parks and open space areas, community and regional trails and staging areas, and utilities; WHEREAS, after several public meetings to consider this ordinance, at its meeting of March 13, 2013, the Planning Commission recommended that the City Council add Chapter 18.70 to the Municipal Code; and WHEREAS, at its meeting of April 16, 2013, the City Council reviewed the report of the Director of Community Development and the recommendations of the Planning Commission regarding the amendment of Title 18 of the Pleasanton Municipal Code regarding ridgeline and hillside protection. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that Chapter 18.70 Ridgeline and Hillside Protection and Preservation implements Measure PP and is consistent with the Pleasanton General Plan. SECTION 2. The new Chapter 18.70 is added to the Pleasanton Municipal Code as set forth in Exhibit A, attached hereto and incorporated herein by this reference. SECTION 3. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption. SECTION 4. This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
