THE CITY OF <br />LEASANTONC <br />MEMORANDUM <br />Date: April 15, 2013 <br />To: Honorable Mayor and Members of the City Council <br />From: Nelson Fialho, City Manager <br />Brian Dolan, Director of Community Development 01 <br />Subject: Case PUD- 85- 08- 1D- 4M/P13 -0030, Pleasant Partners LLC <br />Since the writing of the City Council staff report, a Planning Commissioner brought to staff's attention <br />that two of the conditions of approval were not modified to accurately reflect the Planning <br />Commission's motion. Staff acknowledges the discrepancies and recommends that the conditions be <br />modified as follows: <br />72. The proposed retail buildings shall have a minimum of one master water meter per building. <br />Each retail tenant space and each residential unit shall be sub - metered for sewer and/or water <br />billing purposes. <br />101. The developer and/or property management shall use reclaimed gray water, rain water, etc., for <br />landscape irrigation when available. Details and/or plans shall be provided for review and <br />approval by the Director of Community Development before use of the reclaimed gray water; <br />,to etc <br />In addition, after discussions between the Pleasanton Unified School District and the applicant, the <br />school district is requesting that the school fee condition be revised to read as follows: <br />94. All Residential Units: The applicant shall work with the Pleasanton Unified School District <br />(PUSD) to develop a program to offset this project's long term effect on school facility needs in <br />Pleasanton. This program shall be designed to fund school facilities necessary to offset this <br />project's reasonably related effect on the long -term need for expanded school facilities. The <br />method and manner of providing these funds and/or facilities to PUSD by applicant shall be <br />approved by PUSD and in place prior to building permit issuance. Written proof of compliance <br />with this condition shall be provided by applicant to the City, on a form generated by PUSD, <br />prior to building permit issuance. <br />Retail Buildings: Prior to issuance of a building permit, the applicant shall pay the required <br />commercial development school impact fee as prescribed by State law and as adopted by the <br />Pleasanton Unified School District. <br />Since the school fee language was also included in the proposed development agreement for the project, <br />staff revised the development agreement (attached) to reflect this change. <br />
