CITY COUNCIL AGENDA REPORT <br /> April 16, 2013 <br /> Community Development <br /> Planning Division <br /> TITLE: CONSIDER APPLICATIONS FOR: (1) PLANNED UNIT DEVELOPMENT <br /> MAJOR MODIFICATION AND DEVELOPMENT PLAN (PUD-85-08-1D- <br /> 4M) TO CONSTRUCT 305 APARTMENT UNITS, TWO RETAIL <br /> BUILDINGS TOTALING 7,520 SQ. FT., NEW SURFACE PARKING AND <br /> A PARKING GARAGE TO SERVE THE EXISTING OFFICE USES AT <br /> THE CALIFORNIA CENTER PROPERTY LOCATED AT 4400-4460 <br /> ROSEWOOD DRIVE; (2) AN AFFORDABLE HOUSING AGREEMENT; <br /> (3) GROWTH MANAGEMENT APPROVAL; AND (4) DEVELOPMENT <br /> AGREEMENT. <br /> SUMMARY <br /> The applications are for a high-density residential/commercial development containing <br /> 305 apartment units and approximately 7,520 square-feet of retail space and <br /> replacement office parking including a parking garage on the CA Center site in <br /> Hacienda. Related land use entitlements include an affordable housing agreement, a <br /> growth management agreement, and a development agreement. <br /> HOUSING COMMISSION RECOMMENDATION <br /> The Housing Commission took no action on the affordable housing agreement as it felt <br /> that that the project should include a deeper level of affordability. <br /> PLANNING COMMISSION RECOMMENDATION <br /> The Planning Commission recommended approval of the PUD major modification and <br /> development plan application subject to the conditions shown in Exhibit A (Attachment <br /> 1) and recommended approval of the development agreement. The Planning <br /> Commission also recommended that the City Council provide policy direction to the <br /> Housing Commission regarding affordable housing to assist the Housing Commission in <br /> its affordable housing recommendations as other housing projects move forward. <br /> RECOMMENDATION <br /> 1. Find that the conditions described in CEQA Guidelines Section 15162 have not <br /> occurred as described in the Addendum to the SEIR and find that the previously <br /> prepared SEIR, including the adopted CEQA Findings and Statement of Overriding <br /> Considerations, and the Addendum to the SEIR are adequate to serve as the <br /> environmental documentation for this project and satisfy all the requirements of <br /> CEQA; <br /> 2. Find that the proposed PUD development plan and development agreement are <br /> consistent with the General Plan; <br />
