THE CITY OF 7 <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON. <br /> January 15, 2013 <br /> Community Development <br /> Planning Division <br /> TITLE: P12-1753, CITY OF PLEASANTON - CONSIDER AMENDMENTS TO <br /> TITLE 18 (ZONING) OF THE PLEASANTON MUNICIPAL CODE TO <br /> MODIFY CHAPTER 18.08 (DEFINITIONS) AND ADD A NEW CHAPTER <br /> 18.105 (COTTAGE FOOD OPERATIONS) ESTABLISHIING A PERMIT <br /> PROCESS AND PERFORMANCE STANDARDS FOR HOME-BASED <br /> FOOD PRODUCTION AND SALES IN RESIDENCES. <br /> SUMMARY <br /> The State legislature has enacted two new laws that require cities and counties to allow <br /> persons to prepare and package certain types of non-perishable foods from their <br /> homes, and then sell such food either from their homes or from other locations. <br /> Therefore, staff is proposing changes to the Pleasanton Municipal Code that meet the <br /> State Legislature's stated purpose of these new laws (AB 1616 and AB 2297) by <br /> establishing performance standards for cottage food operations that will ensure that <br /> such operators meet current City ordinances, standards, and/or requirements. <br /> PLANNING COMMISSION ACTION <br /> At their November 28, 2012 meeting, the Planning Commission unanimously <br /> recommended approval of the Code Amendments as outlined in Attachment 1. <br /> RECOMMENDATION <br /> Introduce the draft ordinance amending the Pleasanton Municipal Code as shown in <br /> Attachment 1. <br /> FINANCIAL STATEMENT <br /> Business license fees would apply to a cottage food operation; no fiscal impact on the <br /> City is anticipated. <br />
