RESOLUTION NO. 12-496 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> GRANTING THE APPEAL OF BRIAN AND CHRISTINE BOURG TO OVERTURN <br /> THE PLANNING COMMISSION DECISION APPROVING THE APPLICATION OF <br /> DAVE AND FRANCINE CUNNINGHAM FOR A DESIGN REVIEW TO REPLACE THE <br /> SINGLE STORY HOUSE LOCATED AT 205 NEAL STREET, AS FILED UNDER CASE <br /> NOS. P11-0709 AND P11-0717 <br /> WHEREAS, Dave and Francine Cunningham applied for Design Review approval to <br /> replace the approximately 482-square-foot, single-story house located at 205 Neal Street with <br /> an approximately 1,710-square-foot two-story residence and for variances from the Pleasanton <br /> Municipal Code to: (1) reduce the front yard setback from the required 23 feet to 20 feet to <br /> accommodate the new house; (2) allow one required off-street parking space to be located in <br /> the required front yard setback; and (3) allow tandem parking; and <br /> WHEREAS, zoning for the property is R-1-6,500 (One-Family Residential) District and <br /> the replacement of the existing home is allowed pursuant to Pleasanton Municipal Code <br /> Sections 18.120.030 (addition to nonconforming residential use), 18.120.040 and 18.120.050 <br /> (replacement of nonconforming residential use rebuilt at same density); and <br /> WHEREAS, at its meetings of April 13, 2011, November 9, 2011, and November 30, <br /> 2011, the Planning Commission, having considered all public testimony, relevant exhibits, and <br /> recommendations of City staff concerning this application, approved the application, which was <br /> revised prior to the November 30, 2011 meeting, and the Commission added for the record that <br /> it does not support future subdivision of the property; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Brian and <br /> Christine Bourg submitted an appeal of the Planning Commission decision to the City Council; <br /> and <br /> WHEREAS, at its meeting of February 7, 2012 the City Council received a report from <br /> the Director of Community Development, together with a copy of the staff report to the Planning <br /> Commission, regarding this matter; and <br /> WHEREAS, the City Council held a public hearing on February 7, 2012, at which time <br /> the appellants, applicants, and other members of the public were offered an opportunity to <br /> present evidence regarding the appeal; and <br /> WHEREAS, after a review of the materials presented, the City Council determined that <br /> the proposed two-story home would not be appropriate for the site. <br />
