PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-22 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF THE <br />CITY OF PLEASANTON TO AMEND THE PLEASANTON MUNICIPAL CODE TO <br />ADD CHAPTER 9.21 REGARDING CONSTRUCTION AND DEMOLITION <br />RECYCLABLE MATERIAL, AS FILED UNDER CASE PRZ-08 <br />WHEREAS, the City of Pleasanton has filed an application to add Chapter 9.21 to the Pleasanton <br />Municipal Code requiring the reuse or recycling of a minimum of 50 percent of the <br />debris generated from new construction and demolition projects; and <br />WHEREAS, at its meeting of Mazch 27, 2002, the Planning Commission recommended approval <br />of the Negative Declaration prepared for the proposal; and <br />WHEREAS, at its duly noticed public hearing of Mazch 27, 2002 the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning the amendment to the Municipal Code; and <br />WHEREAS, the Planning Commission determined that the environment and residents of <br />Pleasanton would benefit from the conservation of natural resources provided for <br />within the proposed construction and demolition ordinance. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PRZ-08, the application of the City of Pleasanton, <br />to add Chapter 9.21 to the Pleasanton Municipal Code requiring the reuse or <br />recycling of a minimum of 50 percent of the debris generated from new <br />construction and demolition projects as shown on Exhibit "A," attached hereto <br />and made part of this case by reference. <br />Section 2. Conditions the recommendation for approval on the premise that the City Council <br />will renegotiate the C&D portion of the franchise agreement with Pleasanton <br />Garbage Service to remove the exclusive provision of the C&D requirement to <br />allow adeveloper/builder to use other recyclers, and to finalize the documentation <br />routines prior to the ordinance going into effect so that the documentation gives the <br />City complete assurance that the materials aze being recycled, where it goes to get <br />recycled, and that the facilities aze competent, and that the documentation is <br />adequate enough for use in reaching LEED certification with the U.S. Green <br />Building Council. <br />
