PC-2002-11 <br /> <br />RESOLUTION UPHOLDING CASE PAP-27, THE APPEAL OF THE STAFF <br />REVIEW BOARD'S APPROVAL OF CASE PMS-09, THE APPLICATION OF <br />FRANK AND BARBARA BERLOGAR <br /> <br />WHEREAS, the Staff Review Board approved the application of Frank and Barbara <br />Berlogar for a tentative parcel map that would allow the division of an <br />existing 45.03-acre property located at 2200 Vineyard Avenue into two <br />parcels (Parcel One, 7.57 acres in area, and Parcel Two, 37.46 acres in <br />area) in conformance with PUD-5, an approved PUD Development Plan; <br />and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Planning <br />Commissioner Matt Sullivan filed an appeal of the Staff Review Board's <br />decision; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR, HR, <br />and OS (Low Density Residential, Hillside Residential, and Open Space) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of February 13, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the proposed two-lot parcel map would be covered by the Final <br />Environmental Impact Report approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan; and <br /> <br />WHEREAS, the Planning Commission determined that the approval of the tentative <br />parcel map would not be in accordance with the provisions of the <br />Vineyard Corridor Specific Plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Denies the application of Frank and Barbara Berlogar for a tentative parcel <br />map that would allow the division of an existing 45.03-acre property <br />located at 2200 Vineyard Avenue into two parcels (Parcel One, 7.57 acres <br />in area, and Parcel Two, 37.46 acres in area) in conformance with PUD-5, <br />an approved PUD Development Plan. <br />
