PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2002-05 <br /> <br />RESOLUTION APPROVING CASE PAP-26, THEREBY DENYING THE <br />ZONING ADMINISTRATOR'S APPROVAL OF AN APPLICATION FOR <br />DESIGN REVIEW AND A VARIANCE, AS FILED UNDER CASE <br />PDR-73/PV-60 <br /> <br />WHEREAS, <br /> <br />the Zoning Administrator approved the application of Allen and Sally <br />Roberts for design review approval to construct an approximately 6,400- <br />square-foot, single story, stepped-pad home and variance approval to <br />allow additional grading over the 7,500-square-foot zoning regulation <br />limit for the lot located at 24 Grey Eagle Court; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal Code, Robert Grove <br />(a neighboring property owner) filed an appeal of the Zoning <br />Administrator's decision; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low <br /> Density Residential) District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of January 23, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br /> the California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed grading and house <br /> design were not appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PAP-26, thereby denying the approval of the Zoning <br />Administrator of Case PDR-73/PV-69, the application of Allen and Sally <br />Roberts for design review approval to construct an approximately 6,400- <br />square-foot, single story, stepped-pad home and variance approval to <br />allow additional grading over the 7,500-square-foot zoning regulation <br />limit for the lot located at 24 Grey Eagle Court. <br /> <br /> <br />
