THE CITY OF 14 <br /> ^, ° "' CITY COUNCIL AGENDA REPORT <br /> PL E ASANTON. <br /> October 5, 2010 <br /> Community Development <br /> Planning Division <br /> TITLE: PRZ -57 — CITY OF PLEASANTON — INTRODUCE AN ORDINANCE TO <br /> AMEND THE ZONING FOR THREE SITES IN HACIENDA BUSINESS <br /> PARK TO REMOVE SECTION 5 OF ORDINANCE NO. 1998 AND TO <br /> ALLOW SUBMITTAL OF DEVELOPMENT APPLICATIONS <br /> CONSISTENT WITH THE SETTLEMENT AGREEMENT APPROVED BY <br /> THE CITY COUNCIL ON AUGUST 17, 2010 IN THE CASE OF URBAN <br /> HABITAT V. CITY OF PLEASANTON. THE THREE SITES ARE: <br /> (1) THE W.P. CAREY SITE AT THE SOUTHEAST CORNER OF OWENS <br /> DRIVE AND WILLOW ROAD (ASSESSOR'S PARCEL NO. 941 -2778- <br /> 013 -00 AND PART OF APN 941 - 2778 - 012 -00); (2) THE BRE SITE AT <br /> THE NORTH CORNER OF HACIENDA DRIVE AND GIBRALTAR DRIVE <br /> (APN 941 - 2778 - 011 -00); AND (3) THE ROCHE MOLECULAR SYSTEMS <br /> SITE, SOUTH OF GIBRALTAR DRIVE BETWEEN WILLOW ROAD AND <br /> HACIENDA DRIVE (A PORTION OF APN 941 - 2761 - 003 -00). <br /> SUMMARY <br /> This is a City- initiated proposal to amend the zoning on three sites in Hacienda <br /> Business Park. In October 2009, these sites were rezoned to allow for mixed use and <br /> residential development, although Section 5 of Ordinance No. 1998 stated that any <br /> subsequent development plan for mixed use or residential development could not be <br /> approved until the completion of the work of the Hacienda Task Force and adoption of a <br /> PUD Major Modification (Attachment 2: Ordinance No. 1998). With the Settlement <br /> Agreement approved by the City Council in August 2010, the City Council agreed to <br /> remove this particular section of Ordinance 1998. See attached Planning Commission <br /> Staff Report of September 15, 2010, for additional background information, project <br /> description, and discussion. <br /> PLANNING COMMISSION ACTION <br /> On September 15, 2010, the Planning Commission by a 5 -0 vote, recommended <br /> approving the proposed amendment to the zoning (Attachment 3). <br /> FINANCIAL STATEMENT <br /> The City Council's action will have no financial impact. Any future development will pay <br /> all required building permit and development fees, and will pay property taxes. <br />
