THE CITY OF 1 <br /> ° Dr._ CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON. <br /> October 5, 2010 <br /> Community Development <br /> Planning Division <br /> TITLE: PUD- 80- 16 -13M, LBA REALITY — CONSIDER AN APPLICATION FOR A <br /> PUD MAJOR MODIFICATION FOR AN APPROXIMATELY 64,474 - <br /> SQUARE -FOOT, TWO -STORY RESEARCH AND DEVELOPMENT <br /> BUILDING WITH AN ENCLOSED OUTDOOR SERVICE YARD ON A <br /> DEVELOPED 26.15 -ACRE SITE DEFINED BY FRANKLIN DRIVE AND <br /> JOHNSON DRIVE (4900 — 5040 JOHNSON DRIVE). <br /> SUMMARY <br /> This is the application by LBA Realty for a PUD major modification to allow an <br /> approximately 64,474- square -foot, two -story research and development building with an <br /> enclosed outdoor service yard on a 26.15 -acre, developed five - building site defined by <br /> Franklin Drive and Johnson Drive. The proposal is consistent with the development <br /> pattern of the surrounding area including uses, building and site designs; will enhance the <br /> City's employment base; will be photovoltaic ready and will be ready for electric vehicle <br /> charging stations; will feature TSM measures for all six buildings; will pre -treat <br /> stormwater runoff; and will be constructed to a LEED "Certified" level or will conform to <br /> CalGreen standards, if applicable. Environmental review was completed with an Initial <br /> Study /Mitigated Negative Declaration that has completed its 20 -day CEQA review. <br /> PLANNING COMMISSION ACTION <br /> On September 15, 2010, the Planning Commission, on a 5 -0 vote, recommended <br /> approving the proposed modification subject to the conditions of approval (Attachment 6). <br /> RECOMMENDATION <br /> Staff recommends the City Council adopt the draft resolution approving the Initial Study/ <br /> Mitigated Negative Declaration in Attachment 2, make the PUD development plan <br /> findings in Attachment 3, and introduce the ordinance approving Case PUD- 80- 16 -13M <br /> subject to the draft conditions of approval in Attachment 1. <br /> FINANCIAL STATEMENT <br /> In the short term, the applicant will pay building permit and development fees including <br /> the commercial school impact and traffic impact fees and in -lieu park dedication fees. In <br /> the long term, the project will add to the City's overall assessed value and, therefore, will <br /> improve property tax revenue. <br />
