AMENDMENT TO <br /> PROMISSORY NOTE <br /> Secured by Second Deed of Trust <br /> Pleasanton, California <br /> February 21, 2010 <br /> This Amendment to Promissory Note Secured by Second Deed of Trust (the <br /> "Amendment ") is executed by Benjamin E. Sarcia and Fe A. Sarcia, husband and wife <br /> (collectively the "Borrower ") and agreed to by the City of Pleasanton (the "City" or the <br /> "Lender ") to amend that Promissory Note Secured by Second Deed of Trust for the <br /> principal amount of $20,000, plus interest, executed by Borrower and dated February <br /> 18, 2004 (the "Loan "), and secured by a Deed of Trust dated February 18, 2004 and <br /> recorded on February 24, 2004, in the Official Records of Alameda County as <br /> Instrument No. 2004077143 against real property commonly known as 5935 Knoll <br /> Woods Court, Pleasanton, CA. <br /> A. Based on financial hardship information presented by Borrower to the City, <br /> the City agrees to amend the interest rate and term of the Loan as provided in this <br /> Amendment. <br /> B. Section 3.0 of the original Promissory Note is amended to change the annual <br /> simple interest rate from 4.13% to 2.063 %, and extend the term of the loan from fifteen <br /> (15) years to thirty (30) years. Borrower's monthly payment will now be seventy -four <br /> dollars and fifty -five cents ($74.55). <br /> C.
