CITY COUNCIL OF THE CITY OF PLEASANTON ALA}~EDA COUNTY, CALIFOPjqlA ORDINANCE NO. 1115 ORDINANCE AMENDING LAPSING PROVISIONS OF THE GROWTH MANAGEMENT PROGRAM TO RECOGNIZE SUB- DIVISIONS AS VESTING GROI,~FH ~NAGEME.~]T PROGP~IM APPROVAL THE CITY COUNCIL OF THE CITY OF PLEASA.~]TON DOES HEREBY ODDAIN AS FOLLOWS: Section 1: Section 2-30.05 (b)(9) is amended to read as follows: " (9) Lapse of DeveloDment Approval. Any development approval for projects granted under the yearly allocation for smaller projects shall lapse and be of no further force and effect as of eighteen (18) months from the date small project approval is received unless either: (i) construction has commenced on any building in the project, or (ii) City Council has approved a final map and subdivider has entered into a subdivision agreement (including bondinR for public improvements as appropriate) for the project. In addition, failure to pay Growth Management fees at the times specified in Exhibit "A" to Resolution No. 82-66 as amended by Resolution No. 82-440 or as later amended may result in lapse of small project approval. Council may at its discretion extend the period in which to corranence construction for any project." Section 2: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times ," a newspaper of general circulation published in the City of Pleasant on. Section 3: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
