OFF -SITE PUBLIC IMPROVEMENT AGREEMENT (for items to be constructed with Tract 7407) GHC Bordeaux, LLC Bordeaux Property, Tract 7407 THIS AGREEMENT made and entered at Pleasanton, California, this ffi‘- /X^�2.• 1_ day of 2004, by and between: Q GHC Bordeaux, LLC A Delaware LLC 43160 Osgood Road Fremont, CA 94539 Phone: 510-497-8290 (hereinafter referred to as "Subdivider and the CITY OF PLEASANTON, a general law city, located in Alameda County, California, acting through the City Manager and the City Clerk, (hereinafter referred to as "City WHEREAS, Subdivider has a approved tentative map for said tract, lying within the boundaries of the City; duly approved by the Planning Commission; and WHEREAS, Subdivider has presented offsite improvement plans for: a) Vineyard Avenue Corridor Sewage Lift Station, Pleasanton, Alameda County designed by Garber Engineering dated April 22, 2003, approved by the City Engineer on June 4, 2003, bid, and subsequent revisions to plans, prepared Garber Engineering and approved by the City Engineer and; WHEREAS, said plans designate construction of Public Improvements, that the Subdivider intends to dedicate to the City, and WHEREAS, as a condition precedent to accepting this offer of dedication by Subdivider, City requires the improvements of the public ways, installation or extension of certain City services at Subdivider's expense and certain protection for the City on behalf of the public.
