CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1104 AN ORDINANCE AMENDING TITLE II, CHAPTER 2 OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON REGARDING OUTDOOR SALES WHEREAS, the City of Pleasanton has applied to amend certain provisions of Chapter 2, Title II of the Ordinance Code of the City of Pleasanton regarding outdoor sales; and WHEREAS, at its duly noticed public hearing on October 25, 1983, the City Council considered all public testimony relevant documents and recommendations of the staff and Planning Commission; and WHEREAS, Council concurred with the wording provided in the staff report; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Title II, Chapter 2, Article 8 of the Ordinance Code of the City of Pleasanton is hereby amended by adding subsection 2-7.07 (b) (3) as follows: (3) Outdoor "decorative" displays for the purpose of enhancing the appearance of a structure or site, occupying no more than 50 sq. ft. and not located in a public right-of-way or in any required parking area, will be allowed by the Zoning Administrator upon making the finding that such displays are not detrimental to the public health, safety or general welfare. Such displays shall not contain signing (unless they are submitted as a sign). The Zoning Administrator's decision with regard to what constitutes a decorative display may be appealed to the Design Review Board by the affected merchant or property owner. The requirements of Section 2-5.11 of the Code shall not govern such an appeal." Section 2: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton.
