CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1104 <br /> <br /> AN ORDINANCE AMENDING TITLE II, CHAPTER 2 OF THE <br /> ORDINANCE CODE OF THE CITY OF PLEASANTON REGARDING <br /> OUTDOOR SALES <br /> <br />WHEREAS, the City of Pleasanton has applied to amend certain <br /> provisions of Chapter 2, Title II of the Ordinance <br /> Code of the City of Pleasanton regarding outdoor <br /> sales; and <br />WHEREAS, at its duly noticed public hearing on October 25, <br /> 1983, the City Council considered all public <br /> testimony relevant documents and recommendations <br /> of the staff and Planning Commission; and <br /> <br />WHEREAS, Council concurred with the wording provided in the <br /> staff report; <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> Section 1: Title II, Chapter 2, Article 8 of the Ordinance <br /> Code of the City of Pleasanton is hereby amended <br /> by adding subsection 2-7.07 (b) (3) as follows: <br /> <br /> (3) Outdoor "decorative" displays for the purpose <br /> of enhancing the appearance of a structure or <br /> site, occupying no more than 50 sq. ft. and <br /> not located in a public right-of-way or in <br /> any required parking area, will be allowed by <br /> the Zoning Administrator upon making the <br /> finding that such displays are not detrimental <br /> to the public health, safety or general <br /> welfare. Such displays shall not contain <br /> signing (unless they are submitted as a <br /> sign). The Zoning Administrator's decision <br /> with regard to what constitutes a decorative <br /> display may be appealed to the Design Review <br /> Board by the affected merchant or property <br /> owner. The requirements of Section 2-5.11 of <br /> the Code shall not govern such an appeal." <br /> Section 2: This ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The <br /> Valley Times," a newspaper of general circulation <br /> published in the City of Pleasanton. <br /> <br /> <br />
