FIRST AMENDMENT TO <br /> PROMISSORY NOTE &'1 7 <br /> This First Amendment to Promissory Note is entered into as ofJOXI -1 2 2010, by and <br /> between the City of Pleasanton, California, a municipal corporation (the "Lender and Ridge <br /> View Commons Associates, a California Limited Partnership (the "Borrower and amends the <br /> Promissory Note in the original face amount of $2,250,000 dated as of September 1, 1999 (the <br /> "Note <br /> The Lender and the Borrower now desire to revise the Note to increase the amount of the Loan to <br /> $2,475,000. <br /> Now, therefore, for good and valuable consideration, receipt of which is hereby <br /> acknowledged, the parties hereby agree as follows: <br /> 1. The first paragraph of the Note shall be amended and restated as follows: <br /> "FOR VALUE RECEIVED, Ridge View Commons Associates, a California <br /> Limited Partnership (the "Borrower hereby promises to pay to the City of <br /> Pleasanton, California, a municipal corporation (the "Lender the principal <br /> amount of TWO MILLION FOUR HUNDRED SEVENTY -FIVE THOUSAND <br /> AND NO /100 DOLLARS ($2,475,000) (the "Loan with interest on the unpaid <br /> balance at the rate or rates specified below." <br /> 2.
