DAVIDSON <br /> COUNTY RECORDER <br /> CONSTRUCTION AND PERMANENT <br /> DEED OF TRUST <br /> AND ASSIGNMENT OF RENTS <br /> THIS DEED OF TRUST AND ASSIGNMENT OF RENTS is made as of this <br /> 27th day of June, 1988, by Eden Housing, Inc., a California nonprofit <br /> corporation, herein called "Trustor to Santa Clara Land Title Company, a <br /> California corporation, herein called "Trustee for the City of Pleasanton, <br /> California, a municipal corporation, herein called "Beneficiary." <br /> TRUSTOR DOES HEREBY IRREVOCABLY GRANT, TRANSFER, AND ASSIGN to <br /> Trustee, in trust, with power of sale, all that certain property in the City of <br /> Pleasanton, County of Alameda, State of California, described in Exhibit A <br /> attached hereto and by this reference incorporated herein; <br /> Together with all buildings and improvements now or hereafter located <br /> thereon, and all appurtenances, easements, water and water rights, pumps and <br /> pumping plants; all machinery, equipment, appliances and fixtures which may be <br /> attached to or located in or on said buildings and improvements, including <br /> without limiting the foregoing, all machinery, equipment, appliances, and <br /> fixtures for generating or distributing air, water, heat, electricity, light, <br /> fuel or refrigeration or for ventilating or sanitary purposes; safes, built -in <br /> furniture and installations, shelving, partitions, elevators, awnings, window <br /> shades and blinds, light fixtures, fire hoses and brackets and boxes for same, <br /> fire sprinklers, alarm systems, drapes, drapery rods and brackets, screens, <br /> linoleum, carpets, plumbing, laundry tubs, refrigerators, heating units, <br /> stoves, ovens, kitchen equipment, dishwashers, water heaters, incinerators, <br /> furnaces, communication systems, and all installations for which any such <br /> building or improvement is specially designed. All of said items, whether now <br /> or hereafter installed, being hereby declared to be for all purposes of this <br /> Deed of Trust a part of the realty; the specific enumerations herein not <br /> excluding the general. <br /> FOR THE PURPOSE OF SECURING, in such order of priority as <br /> Beneficiary may determine, payment of the loan and indebtedness evidenced by a <br /> Promissory Note (the "Note of Trustor of even date herewith in the principal <br /> sum of FOUR MILLION AND NO /100th DOLLARS ($4,000,000.00), payable to <br /> Beneficiary or order, and any and all modifications, extensions or renewals <br /> thereof, the interest, if any, on such indebtedness according to the terms of <br /> the Note, due and payable if not sooner paid, on July 1, 2020, all other sums <br /> (with interest, if any) becoming due or payable to Beneficiary or Trustee <br /> pursuant to the terms hereof, and such additional loan or loans, when evidenced <br /> by an additional note or notes reciting the same to be secured hereby, with <br /> interest if any thereon, as Beneficiary in its sole discretion may advance to <br />
