ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE APPROVING AN AMENDMENT TO THE DEVELOPMENT <br /> AGREEMENT WITH KENNETH PAMELA CHRISMAN EXTENDING THE TERM OF <br /> THE DEVELOPMENT AGREEMENT BY FIVE YEARS <br /> WHEREAS, Government Code Section 65865 through 65869.5 authorizes cities <br /> and counties to enter into binding development agreements with persons having legal or <br /> equitable interests in real property for the development of such property; and <br /> WHEREAS, in 2002, the City of Pleasanton adopted Ordinance No. 1855 <br /> approving a development agreement between the City and Kenneth Pamela <br /> Chrisman "the Chrismans regarding their property located on Old Vineyard Avenue; <br /> and <br /> WHEREAS, in August 2009, the Chrismans applied to the City for an <br /> amendment to the development agreement that would extend the term of the <br /> agreement for an additional five years; and <br /> WHEREAS, after public notice, on August 12, 2009, the Planning Commission <br /> held a hearing and recommended approval of the amendment to the Development <br /> Agreement; and <br /> WHEREAS, at its meeting of September 15, 2009, the City Council reviewed the <br /> staff report from the Director of Community Development together with a copy of the <br /> staff report to the Planning Commission on this matter; and <br /> WHEREAS, on September 15, 2009, a duly- noticed public hearing was held by <br /> the City Council, at which time the applicant and members of the public were offered an <br /> opportunity to present evidence regarding the amendment to the development <br /> agreement; and <br /> WHEREAS, minor changes to land use regulations such as this are categorically <br /> exempt from CEQA; and <br /> WHEREAS, the City Council finds that the amendment to the Development <br /> Agreement is consistent with the City's General Plan. <br /> NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves the First Amendment to the Development Agreement, a <br /> draft copy of which is attached hereto and incorporated herein by reference, the final <br /> form of which is to be approved by the City Attorney. <br />
