c- -cfVo <br /> REIMBURSEMENT AGREEMENT FOR <br /> PLANNING CONSULTING SERVICES FOR THE <br /> HACIENDA BUSINESS PARK PUD MODIFICATION <br /> DEVELOPMENT PLAN <br /> This REIMBURSEMENT AGREEMENT FOR PLANNING CONSULTING <br /> SERVICES FOR THE HACIENDA BUSINESS PARK PUD MODIFICATION <br /> EVE OPMENT PLAN (the "Agreement is entered into this day of <br /> v 200), between the City of Pleasanton, a municipal corporation, (the <br /> and the Hacienda Business Park Owners Association, a ti&n oitt i'u 1040/1-:k <br /> p e eeoz"kb <br /> "Association <br /> RECITALS <br /> A. The Association desires to undertake a planned unit development (PUD) <br /> modification and development plan, including possible design guidelines, for <br /> portions of its 875 acre Hacienda Business Park, located in Pleasanton, California <br /> (the "Project <br /> B. The Association and the City recognize the community interest in a focused <br /> public process, which may include a committee or task force formed for the <br /> purpose or reviewing and making recommendations for the Project, as well as <br /> noticed public hearings before the City's Planning Commission, City Council, and <br /> other boards and commissions as determined by the City. <br /> C. The Association seeks to have, and will reimburse the City for costs paid for a <br /> qualified design and urban planning consultant, experienced with thc City's <br /> planning process, to work for the City under a contract for consultant services <br /> dedicated to this Project. <br /> NOW, THEREFORE, the parties agreed as follows: <br /> 1. Reimbursement of Consultant Services. The City will enter into a contract <br /> with Jerry Iserson for design and urban planning consultant services for the Project, <br /> including: preparing committee task force agendas and reports; taking general <br /> committee meeting notes; providing substantive information and recommendations for <br /> the Project; preparing Planning Commission and City Council staff reports and <br /> presentations; making presentations at the Planning Commission and City Council <br /> meetings; and preparing the document needed by the California Environmental Quality <br /> (CEQA) Act which is anticipated to be a mitigated negative declaration, as more <br /> particularly described in a separate agreement between the City and Mr. Iserson. <br /> The Association shall reimburse the City for the fees and costs that Mr. Iserson <br /> bills the City based on time and materials related to his work on thc Project. Such <br /> reimbursement shall occur within thirty (30) days after the City presents the Association <br /> Page I of 4 <br />
