EAST BAY REGIONAL COMMUNICATIONS SYSTEM AUTHORITY DOOLAN TOWER

ADDENDUM TO LICENSE AGREEMENT (Doolan Tower) THIS ADDENDUM is entered into as of this 1t, day of t 2010, by and between the City of Livermore ("Livermore"), a municipal corporation, having its principal place of business at 1052 South Livermore Avenue, Livermore, CA 94550, the City of Pleasanton ("Pleasanton"), a municipal corporation, having its principal place of business at 123 Main Street, Pleasanton, CA 94566, and the East Bay Regional Communications System Authority("Authority"), a joint powers authority having its principal place of business at the Office of Homeland Security and Emergency Services 4985 Broder Boulevard Dublin, California 94568. Recitals On August 6, 2009, Livermore, Pleasanton, and the Authority entered into a license agreement ("License") to allow the Authority to use certain Licensed Areas on the Property and the Tower situated thereon, as those underlined terms are defined in the License. To support the Authority's installation of its Antenna and related Equipment on the Tower, as those underlined terms are defined in the License, the Authority has requested permission from Livermore and Pleasanton to make structural enhancements to the Tower. Livermore and Pleasanton are amenable to the Tower enhancements subject to the terms and conditions specified in this Addendum. Agreement NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties hereby agree to the following addendum to the License: 1. Recitals The aforementioned recitals are true and correct. 2. Tower Enhancements Upon written approval by Rhonda Bishop, Police Facility & Equipment Manager, the Authority is authorized to make structural enhancements to the Tower. Ms. Bishop shall approve the enhancements if she determines in her sole discretion that the enhancements: A.
