CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1509 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> SHAPET~. INDUSTRIES OF NORTHERN CALIFORNIA FOR <br /> REZONING AND DEVELOPMENT PLAN APPROVAL AS <br /> FILED UNDER CASE PUD-90-18 <br /> <br />WHEREAS, Shapell Industries of Northern California has applied for <br /> development plan approval for construction of 106 new <br /> single-family residential units on an approximately 104 <br /> acre site and rezoning of the site from "A" <br /> (Agricultural) District to PUD (Planned Unit Development) <br /> - Medium Density Residential/Low Density Residential/and <br /> Rural Density Residential District; said site is located <br /> at the northerly and southerly sides of Bernal Avenue, <br /> approximately 2,250 feet southeasterly of Sunol <br /> Boulevard; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared for this <br /> project and on May 21, 1991, a resolution certifying the <br /> Environmental Impact Report as complete and adequate was <br /> adopted; and <br /> <br />WHEREAS, the EIR disclosed many possible significant adverse <br /> impacts, most of which could be mitigated, but two of <br /> which could not be mitigated to insignificant levels; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the development plan and <br /> rezoning; and <br /> <br />WHEREAS, both staff and Planning Commission have recommended that <br /> benefits of the project - social, economic, and <br /> environmental/land use - outweigh the few significant <br /> adverse environmental impacts, thereby justifying <br /> approval of the project; and <br /> <br />WHEREAS, a duly noticed public hearing was held on May 21, 1991; <br /> and <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> zoning are consistent with the General Plan policies of <br /> the City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: The City Council makes the following findings: <br /> <br /> <br />
