CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1517 AN ORDINANCE OF THE CITY OF pT.RASANTON ADDING A NEW CHAPTER, CHAPTER 3.30, TO THE pT~ASANTON MUNICIPAL CODE TO ~JOW THE CITY TO RECOVER THE COUNTY CRIMINAL JUSTICE ADMINISTRATION FEE FROM A PERSON ARRESTED AND CONVICTED AND DECLARING THE URGENCY THEREOF TO TAKE EFFECT IMMEDIATELY UPON ADOPTION. WHEREAS, the County of Alameda, pursuant to the purported authority of SB2557, imposes on the City of Pleasanton a criminal justice administration fee for all persons who are ,'booked" into the County jail; and WHEREAS, SB21 added Section 29550.1 to the Government Code to allow cities to recover this fee from the person arrested and convicted- THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: A new chapter, Chapter 3.30, is hereby added to the .... Pleasanton Municipal Code to read as follows: ,,Chapter 3.30 Criminal Justice Administration Fee Section 3.30.010 Payment of Fee Any person convicted of any criminal offense related to an arrest shall pay to the City any criminal justice administrative fee imposed on the City by the County of Alameda. Section___ 2: This ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of pleasanton- Section___ 3: This ordinance shall be effective immediately upon its adoption and the reasons for its urgency are as follows: The County has imposed "booking fees" on the City and in the past fiscal year, has withheld over $150,000 in real property tax revenues to cover this alleged fee.
