CITY COUNCIL CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1522 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF RUSSELL <br /> SCHAEFFER FOR REZONING AND DEVELOPMENT PLAN APPROVALAS <br /> FILF. D UNDER CASE PUD-91-08 <br /> <br />WHEREAS, Russell Schaeffer has applied to rezone a 1,401 ! acre <br /> parcel from the Agricultural (A) zoning district to the PUD- <br /> MDR (Medium Density Residential) zoning district and <br /> development plan approval for a five-unit single-family <br /> residential development located at 5059 Foothill Road; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on October 1, 1991; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations <br /> for approval of the rezoning and development plan approval; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held 6n October 1, 1991; <br /> and <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> rezoning is consistent with the General Plan policies of the <br /> City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Approves the rezoning of an approximately 1,401 ~ <br /> acre parcel located at 5059 Foothill Road to the PUD <br /> (Planned Unit Development) - Medium Density Residential <br /> District. <br /> <br />Section 2. The Zoning Map of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating and <br /> dividing the City into zoning districts is hereby amended by <br /> Zoning Unit Map No. 404, attached hereto as Exhibit "A" <br /> dated October 1, 1991, and incorporated herein by reference. <br /> <br />Section 3. Approves the development plan to allow a five-unit <br /> single-family residential development on a 1.401 ~ acre <br /> parcel located 5059 Foothill Road subject to the conditions <br /> on "Exhibit B" attached hereto and incorporated herein by <br /> this reference. <br /> <br /> <br />
