CITY COUNCIL CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1522 AN ORDINANCE APPROVING THE APPLICATION OF RUSSELL SCHAEFFER FOR REZONING AND DEVELOPMENT PLAN APPROVALAS FILF. D UNDER CASE PUD-91-08 WHEREAS, Russell Schaeffer has applied to rezone a 1,401 ! acre parcel from the Agricultural (A) zoning district to the PUD- MDR (Medium Density Residential) zoning district and development plan approval for a five-unit single-family residential development located at 5059 Foothill Road; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on October 1, 1991; and WHEREAS, Council received the Planning Commission's recommendations for approval of the rezoning and development plan approval; and WHEREAS, a duly noticed public hearing was held 6n October 1, 1991; and WHEREAS, the City Council finds that this development plan and rezoning is consistent with the General Plan policies of the City of Pleasanton. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Approves the rezoning of an approximately 1,401 ~ acre parcel located at 5059 Foothill Road to the PUD (Planned Unit Development) - Medium Density Residential District. Section 2. The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning districts is hereby amended by Zoning Unit Map No. 404, attached hereto as Exhibit "A" dated October 1, 1991, and incorporated herein by reference. Section 3. Approves the development plan to allow a five-unit single-family residential development on a 1.401 ~ acre parcel located 5059 Foothill Road subject to the conditions on "Exhibit B" attached hereto and incorporated herein by this reference.
